ZUS contribution arrears – what are the consequences and how to fix them step by step

ZUS contribution arrears are one of those problems that grow the longer you wait. Statutory interest runs from the first day of delay, and ZUS has effective collection tools – including seizing a bank account without prior warning. The good news: arrears can be resolved, and with the right approach, the cost can be limited.

How to check your arrears on ZUS PUE

The first step is to log into the ZUS Electronic Services Platform (pue.zus.pl) and check the payer account balance. The account shows: current debt, unsettled periods, filed and unfiled declarations and payment history. If you don't have ZUS PUE access, you can obtain it via a trusted profile or in person at a ZUS branch.

  • 'Payer account' tab → current and outstanding balance
  • 'Declarations' tab → history of filed DRA declarations and individual reports
  • 'Liabilities' tab → debt breakdown by insurance type and period

What the consequences of contribution arrears are

ZUS has broad collection powers. Before initiating enforcement, it usually sends a reminder – but not always. An employer can expect:

  • Statutory interest on arrears – calculated from the day the contribution was due
  • Bank account seizure – ZUS can do this without a court order
  • Entry in the debtor register
  • Personal liability for directors or shareholders – in limited companies, the management board is personally liable for ZUS arrears if enforcement against the company's assets proves ineffective
  • Refusal to issue a certificate of no arrears – required for public tenders and grants

How to file overdue declarations

If declarations for previous months were not filed, they should be submitted as soon as possible – even after the deadline. Filing a late declaration does not remove interest charges, but it stops the uncertainty about the debt amount and makes it possible to arrange instalment payments.

  • Log into Płatnik or ZUS PUE and prepare a DRA declaration for each missing month
  • Attach individual reports (RCA, RSA) for each insured person to the DRA
  • Submit the documents electronically via PUE or the Płatnik program
  • After submission, check the receipt confirmation and account balance – it may take a few working days

Application for interest waiver – when it's worth trying

ZUS can waive interest on contribution arrears if paying them would destabilise the financial situation of the company or the payer's family, or if the arrears arose for reasons beyond the payer's control (e.g. a sudden unforeseen event, an error by a previous employee). The application is submitted on form RD-UO with supporting documents.

An interest waiver is not guaranteed, but in many cases ZUS grants it – particularly for a first application, a long history of timely payments and a credible justification. It's worth trying, as the interest can be a significant part of the total debt.

Instalment arrangement – how to spread arrears over time

If a lump-sum repayment isn't possible, ZUS allows an instalment arrangement. The application is submitted on form RD-SR. During repayment, ZUS does not pursue enforcement, and instead of interest, a prolongation fee is charged (lower than the interest rate). An instalment arrangement requires consistency – one missed instalment can void the agreement.
